Lawsuit Against Boulder Valley School’s Modular Home Factory Dismissed

In a recent development, a lawsuit aimed at halting the construction of a new modular home factory in Boulder County, Colorado has been dismissed by the Boulder County District Court. The factory project, a collaborative effort between the Boulder Valley School District (BVSD), the city of Boulder, and Flatirons Habitat for Humanity, has garnered attention for its commitment to producing all-electric, solar-powered, and affordable homes using repurposed salvaged steel from the Alpine-Balsam project.

The BVSD owns the 48-acre factory site located at 6500 Arapahoe Road, and in late 2022, the Boulder City Council unanimously voted to annex the BVSD land into the city to facilitate the project’s development. However, two nearby residents, David Hsu and Harald Cassidy, filed a lawsuit on January 11th against the city, city council, and BVSD. Their claim was centered on the argument that the property’s zoning did not permit manufacturing uses.

According to the lawsuit, the Boulder Valley Comprehensive Plan stipulates that the newly annexed property should be zoned as “public” because “manufacturing uses are incompatible with the character of the surrounding neighborhoods.” The lawsuit further contended that the City Council had “improperly circumvented” this requirement.

Importantly, the plaintiffs clarified that their primary objective was not to dispute the annexation of the land but rather to challenge the zoning and land use issues associated with the City Council’s decision.

Additionally, the lawsuit raised concerns about “significant” noise and traffic impacts resulting from previous construction activities on the property. Other nearby residents had also voiced opposition to the project, citing concerns related to noise, traffic, and potential environmental impacts on the nearby Sombrero Marsh.

However, in a court filing dated November 22nd, District Court Judge Dea Lindsey dismissed the lawsuit. Judge Lindsey explained that BVSD is not obligated to adhere to Boulder’s zoning laws “when acting pursuant to its educational mandate” due to the district’s sovereign status. Lindsey further noted that the plaintiffs’ arguments relied on an “unsustainably narrow” interpretation of sovereignty.
